Buying or living in a housing society in Mumbai comes with certain rights and responsibilities. These rules are designed to ensure smooth functioning of the society, maintain peace among residents, and keep the property well-managed.
All housing societies in Mumbai function under the Maharashtra Co-operative Societies Act, 1960 and MahaRERA regulations for transparency.
Every flat owner must become a registered member of the housing society.
Membership is mandatory to vote in society decisions, attend meetings, or make changes to the property.
Once the builder hands over the building, the residents must form a co-operative housing society and register it with the Deputy Registrar of Co-operative Societies.
Every member must pay monthly maintenance charges as decided by the society in General Body Meetings (GBM).
Charges typically include:
Common area cleaning & maintenance
Security staff & amenities
Water and electricity for common use
Repairs and sinking fund
Delay in payment may lead to fines or penalties.
Flats are meant for residential use unless specifically permitted for commercial use.
No illegal business or activities are allowed inside the premises.
Structural changes to flats that affect the external façade or building safety are not permitted without society and municipal approval.
Parking allotment is done as per society policy or builder’s plan.
Residents must park only in their designated space.
Visitors must use visitor parking areas if available.
No obstruction or encroachment in common parking areas is allowed.
Corridors, terraces, clubhouses, lifts, and gardens are common property.
No member is allowed to block or use common spaces for personal storage, construction, or events without prior permission.
Cleanliness and upkeep of these areas is the joint responsibility of all residents.
Residents must keep noise levels low, especially during night hours (10 PM – 6 AM).
Loud parties or functions require prior permission from the society.
No activities causing disturbance to neighbors are allowed.
All major decisions regarding finances, repairs, redevelopment, or upgrades are taken in General Body Meetings.
Every member has one vote.
Minutes of meetings are recorded and must be made available to members.
Structural repairs in common areas are carried out by the society.
Flat owners are responsible for internal maintenance of their own unit.
Any major alterations require society’s No Objection Certificate (NOC) and approval from the BMC/municipality.
Owners must register tenancy agreements with the local police and submit a copy to the society.
Tenants must follow the same rules as members.
Long-term guests should be informed to the society security in advance.
Residents must cooperate with the society on safety measures such as CCTV, security staff, and emergency protocols.
Fire exits must be kept clear at all times.
Illegal storage of hazardous materials is strictly prohibited.
Any redevelopment must follow Maharashtra Government and RERA guidelines.
The decision must be approved by a majority of members through a GBM.
Proper agreements and timelines must be documented and registered.
Violation of society rules can lead to warnings, fines, or legal action under the Co-operative Societies Act.
All disputes are first addressed through the managing committee.
If unresolved, they can be escalated to the Co-operative Court or Registrar.
